HOla compañeros de Menorca, la ley Balear parece ser que os da 10 años, pero sólo a los empresarios que ganen el concurso por méritos que establece el articulo 54 de la Ley 1/2010, de 1 de marzo, de Reforma de la Ley 7/1996 de Ordenación del Comercio Minorista que ha sido desarrollad por el RD 1010/2010, de 26 de febrero, sobre la regulación de la venta ambulante o no sedentaria. RD que ha sustituido al RD 1010/1985.
Sólo con un régimen Transitorio como el conquistado en la Comunidad de Madrid ( también en Canarias y en vias de ser conseguido en Valencia) podeis tener asegurado la permanencia en vuestros puestos de trabajo. Si no hay regimen transitorio todos vuestros puestos saldrán a concurso público ( se ofertaran al mejor postor) en cuento las autoridades políticas lo decidan.
Es importante que tengais un conocimiento más exhaustivo de la legislación básica estatal y de las opciones para permanecer en nuestros puestos de trabajo, y la única vía legal es el Régimen Transitorio con la prórroga automática de las autorizaciones para los titulares que ya estaban en la profesión con anterioridad a la entrada en vigor del RD 199/2010, tal y como la Plataforma de Comerciantes Ambulantes de la Comunidad de Madrid ha conquistado. Primero fue logrando introducir en en el Congreso de los Diputados que la DISPOSICIÓN TRANSITORIA PRIMERA de la Ley 1/2010 de 1 de marzo, permitiera a las Comunidades Autónomas regular dichos regimenes, algo que fue posible gracias a que registramos en el Senado y en el Congreso ( entre otras instituciones sociales y políticas) días antes a que se aprobara esta ley, varios estudios socioeconómicos y juriídicos de las graves consecucias que tendría en miles de familias de profesionales del comercio ambulantes que sacaran nuestros puestos de trabajo a concurso público, sin respetar en nada a los vendedores que tenemos derechos adquiridos. Dejamos claro que se estaba fomentando un proceso de desprofesionalizaciónn, precarización y aumento del paro de los actuales profesionales de los mercadillos. Nuestra voz fue escuchada y gracias a CIU que propuso al PSOE que se aprobara la Disposición Transitoria Primera, en los términos que contempla la ley se abrió el paso a que las Comunidades Autónomas pudieran regular estos regímenes transitorios, porque, en España son las Comunidades las que tienen las competencias exclusivas en materia de comercio interior, si bien dentro del marco establecido por las leyes estatales.
Por lo tanto, compañeros es posible permanecer en nuestros puestos de trabajo a pesar de la Directiva de Servicios o Directiva Bolkestein, pero sólo a través del régimen transitorio, de otra manera vuestros puestos irán a parar a manos de nuevos empresarios y cooperativas que es lo que buscan determinadas organizaciones del comercio ambulante que se beneficiarían de nuestra pérdida. Por lo tanto !!OJO!! aqui en Madrid, en Murcia, Valencia, Canarias y algunas otras Comunidades ya tenemos detectados quienes son los enémigos del sector: organizaciones ilegítimas que han negociado nuestro futuro laboral a espaldas nuestras. SI QUEREIS VER LO QUE ES EL CONCURSO Y EL SISTEMA DE BAREMACIÓN MIRAR LA ORDENANZA DE MÁLAGA PARA LA VENTA AMBULANTE UN EJEMPLO DE EXPULSIÓN EN TODA REGLA….. En la Comunidad de Madrid dichas organizaciones están señaladas y desenmascaradas

Hola compañeros. Por andalucía andamos como siempre rezagados, sin saber por donde coger el toro. Yo en concreto no tengo ni idea de por donde ni como intentar revertir la que nos viene encima. Cualquier información de cómo encauzar el tema, será muy bienvenido
hola compañeros ,desde asturias estamos luchando por mantener los mercadillos navideños ya que estan sacando todo a concurso y tambien intentando gestionar desde los ayuntamientos estos eventos queriendo sacarnos a todos los que llevamos casi 30 años ya nuestra asociacion avca(asociacion de vendedores callejeros de asturias)….estamos intentando contactar con vtros si nos facilitais un numero de contacto o correo os lo agradeceriamos.esto va a ser la tonica general de estos proximos años asi que creo que necesitamos unir ntras fuerzas!!
